Not sure how to handle the matter where your blood alcohol exceeded the legal limit?

Have a career that will be adversely affected by a criminal record?

We assist clients with making the necessary representations to the National Prosecuting Authority to have a matter withdrawn.

Section 65 of the National Road Traffic Act 93 of 1996 regulates the legal limit of alcohol allowed in a person’s blood or breath whilst driving as well as the prohibition of driving whilst under the influence of alcohol. The legal limit for blood alcohol is 0.05g per 100ml or 0.24mg per 1000ml of alcohol in breath.

We review a matter with clients to ensure that all the necessary steps were taken according to correct procedures. This includes drawing of blood or obtainment of breath samples and the handling of such samples. If the correct procedures were not followed by the role-players in the legal system, we demand and have charges withdrawn.

We ensure that clients’ personal circumstances and the circumstances of the incident which caused them to be arrested, are thoroughly explained to and canvassed with the prosecutor. We ensure that the prosecution sees a client as a human being with flaws and skills. We ensure that the prosecution comprehends of the importance of a person’s contribution to society in respect of those unique skills he or she has. Thereby, we assure the prosecution of clients’ value to society and that that value should not be diminished or frustrated by a criminal record.
